Unlike in some countries and regions (such as the European Union), the Ukrainian procedure involves two stages of examination: a formal examination and a substantive examination. During the substantive examination, patent office examiners thoroughly check the trademark to ensure it is not confusingly similar to other registered or pending trademarks. Even in the absence of a third-party opposition, a UKRNOIVI examiner may independently identify grounds for refusal by comparing the trademark application against existing ones. Another factor is the high volume of applications, which significantly exceeds the capacity of the current team of examiners. These factors substantially slow down official registration compared to certain foreign patent offices, where only a single-stage check for compliance with formal requirements is conducted. Thus, the combination of a complex examination process and a heavy system workload results in a long waiting period for the outcome.
