International trademark registration through the Madrid System is an effective and cost-efficient solution for expanding the geographic scope of legal protection for your brand.
The Madrid System for the international registration of marks is administered by the World Intellectual Property Organization (WIPO) in Geneva, Switzerland. It was established to simplify the process of obtaining and maintaining trademark protection in many countries worldwide.
Using the Madrid System for international registration provides trademark owners with several significant advantages:
- Single Application —One application is filed in one language (English, French, or Spanish), instead of submitting separate applications to the trademark offices of each country.
- Single Fee Payment—Fees are paid centrally to the WIPO International Bureau.
- Centralized Management—All subsequent changes, such as a change in the owner's name or address, a full or partial change of ownership, or a limitation of the list of goods and services, can be registered and take effect through a single procedure at the International Bureau and the payment of one fee.
- Time and Cost Savings—There is significant financial savings in obtaining and maintaining trademark protection abroad.
What is the procedure for international TM registration?
Base Mark: The International application must be based on a mark already registered or an application for registration in Ukraine. The list of goods and services in the International application cannot be broader than those of the base mark.
Filing the Application: The International application is filed with the International Bureau through the national office.
Publication in the International Gazette: After checking for compliance with the requirements, the mark is registered in the International Register and published in the "WIPO Gazette of International Marks".
Countries: You can designate one or more countries (territories) where you wish to obtain protection.
Registration in Designated Countries: The Office of each designated country conducts an examination. If no refusal is received within the established term (in most cases, 12 to 18 months), protection of the mark is considered granted.
Period of Dependence: For five years from the date of registration, the International registration remains dependent on the base mark. If the base mark ceases to be effective (for example, is annulled, refused, or withdrawn), the International registration also loses protection, either fully or partially.
Independence and Renewal: After the five-year period, the International registration becomes independent of the base mark. It can be maintained indefinitely by paying fees every 10 years.
